What's insured?

  • ✔ protection of your product from accidental damage (including water damage)
  • ✔ breakdown of your product after the end of the manufacturer’s guarantee period
  • ✔ unlimited repairs on your product (including call-outs, parts and labour), with no excess to pay
  • ✔ a replacement product (for example where we cannot repair it or we decide that it is uneconomical for us to repair your product) and the cost of delivering your replacement product
  • ✔ vouchers to the value of a replacement product (if we cannot reasonably arrange a replacement)

What's NOT insured?

  • ✘ loss, cosmetic damage, theft, neglect or deliberate damage
  • ✘ Breakdown or accidental damage covered by another guarantee or warranty.
  • ✘ costs arising from not being able to use your product or damage to other property
  • ✘ costs for replacing any accessories, installation and disposal

Are there any restrictions on cover?

you must be at least 18 years old and resident in the UK

your product must be in good working order and less than 45 days old when this policy starts

your product must have been bought from mygroovyplace.com

Where am I covered?

your product is covered under this policy while it is located anywhere in the world; however any repairs or replacement under this policy will only be carried out within the UK

What are my obligations?

  • to give us true, factual and not misleading information
  • to install, maintain and use the product in a private home, for non-business purposes and to follow the manufacturer’s instructions
  • to ensure your appliance meets relevant safety standards and is safe to work on

When and how do I pay?

You need to either pay the total premium in one full payment before the policy starts or in monthly installments by the agreed payment method, unless the policy has been provided to you at no charge.

When does the cover start and end?

Cover starts

  1. on the purchase date of your product, or
  2. if your product is a large item and mygroovyplace.com deliver it directly themselves, on the scheduled delivery date of your product, or
  3. if later, on the purchase date of the policy.

Cover lasts for 2, 3 or 4 years depending on your product and its manufacturer’s guarantee (unless ended in accordance with our terms and conditions).

The duration of cover will be confirmed on your receipt or certificate of insurance. If you cancel within the 45 day cooling off period you will receive a full refund of any premium paid. If we give you a replacement or vouchers for a replacement the policy will end immediately and no premium will be refunded.

How do I cancel the contract?

If you have paid in advance (or been provided the policy at no charge) and wish to cancel during the first 14 days, please contact us at customerservices@mygroovyplace.com.

Thank You for choosing this Extended Warranty policy, which is underwritten by Financial & Legal Insurance Company Limited. You now have Extended Warranty insurance to protect You in relation to the benefits set out in this policy.

This policy meets the needs of a customer who wishes to protect their appliance(s) against actual sudden and unforeseen electrical or mechanical failure. This insurance covers electrical and mechanical failure as detailed within this policy document. A summary of the cover provided by this policy is shown in Your Insurance Product Information Document (IPID) document.

You are entitled to cancel Your policy with a full premium refund within 14 days of it starting, provided that there have been no claims. Please see the Cancellation section for full details.

Please read this policy document carefully and keep it in a safe place. This insurance is a contract between Us and You.

We will, subject to the terms of this policy, provide You with the insurance set out in the policy in respect of claims occurring during the Period of Insurance shown in the Certificate of Insurance and for any subsequent period for which We may accept a renewal premium.

You must ensure that all the information You have given to Us is accurate to the best of Your knowledge. We will be entitled to refuse to accept a claim where You do not take reasonable care not to make a misrepresentation.

The policy, Certificate of Insurance and any endorsements must be read together as one document. If You would like these documents in another format, please let Us know.

We hope that Your Appliance will be trouble free. However, if it should experience a Mechanical or Electrical Breakdown during the Period of Insurance, please follow the claims procedure detailed in Your policy.

DEFINITIONS

The words or expressions detailed below have the following meaning wherever they appear in this policy and will appear with a capital letter and in Bold.

  • Administrator: Warranty Solutions, for queries relating to the issue of Your policy / policy amendments and to report details of any claim during the period of the policy.
  • Appliance / Appliances: As detailed on the Certificate of Insurance, cover only extends to the item(s) detailed on Your Certificate of Insurance.
  • Certificate of Insurance: Means the document headed Certificate of Insurance that contains details of You, the Appliances covered level of cover selected, the commencement date, the expiry date, the maximum claim limit and the Period of Insurance.
  • Home: The property situated in the United Kingdom as stated on the policy Certificate of Insurance/certificate
  • Insured / You / Your: The person or persons named on the policy Certificate of Insurance.
  • Mechanical / Electrical Failure: The actual and sudden Mechanical / Electrical Failure or breakdown which results in the sudden stoppage of the Appliances normal function, and which necessitates repair to resume those functions. The cover commences on the date on Your Certificate of Insurance and expires at the date stated on the Certificate of Insurance.
  • Period of Insurance: The period stated in the Certificate of Insurance that attaches to this policy.
  • We / Us / Our: Financial & Legal Insurance Company Limited.

WHAT IS COVERED

If the Appliance / Appliances breaks down due to Mechanical or Electrical Failure We will at our discretion repair or replace the Appliance / Appliances on condition that:
• The Appliance has been correctly installed in line with the manufacturer’s guidelines.
• The Appliance has been used for normal purposes only and in accordance with the manufacturer’s operating instructions.
• The Appliance has not been repaired, taken apart or tampered with by any person not authorised by Us.
• All repair work under this policy must be undertaken by the Administrator or its authorised agents.
• Proof of purchase and the policy insurance documentation is available. • If We decide Your Appliance cannot be repaired We will replace it with the same model. If the same model is no longer available, We will discuss an alternative model with You at which point the cover will cease.


What is Not Covered

  • Damage resulting from transportation, not being used in accordance with the manufacturer’s operating instructions or neglect.
  • Cost of repairs which are made outside of the United Kingdom.
  • Consumer replaceable items including, but not limited to, batteries and other consumables.
  • Cosmetic damage and/or non-functional parts which do not affect the normal use of the Appliance including for example cabinet trim, scratches, and rust.
  • Any loss suffered as a result of not being able to use the Appliance or any loss other than the repair or the replacement cost of the product.
  • Faults that are subject to a manufacturer’s recall program.
  • Faults arising from any electronic virus infection or software failures.
  • Any claim when the Appliance has not been maintained as per the guidance within the manufacturer’s Operation Instruction Manual.

We reserve the right to charge for the expense of a service call if no fault has been found with the Appliance after We have inspected it.

Claims Procedure

It is vital to obtain pre-authorisation under Your policy in the event of a claim and that You contact the Administrator, Warranty Solutions on tel: 01759 487828

Please provide the Administrator with as much information possible about what has happened so they can give advice and arrange for an engineer to contact You. The engineer will contact You within 24 hours of you contacting the Administrator.

Please have Your policy number which is shown at the top of Your Schedule and details of the Appliance ready when You call.

Repairs carried out without gaining authorisation may result in the cost of claim not being reimbursed.

Claims are only valid where authority has been issued by the Administrator or their appointed engineer.

  1. The Administrator will arrange an engineer visit within 5 working days, provided that provision of service is not precluded by:
  • adverse Weather conditions;
  • industrial disputes (official or not);
  • failure of the public transport system (including the road network) and repair thereto;
  • Other circumstances preventing access to Your Home or otherwise making it impossible to provide the claims service.
  • You will be responsible for engineer’s call out charges if having requested assistance You are not at Home when the engineer arrives.
  • We will arrange to supply and fit replacement parts or components where required and covered under Your policy. If You request any additional work or replacement parts or components fitting of a superior specification, You will be responsible for the additional cost.

We are not responsible for any inconvenience, loss or damage caused by delay in the supply of spare parts or components by manufacturers or their suppliers or agents.

GENERAL CONDITIONS

  • Observance of Terms
    Anyone making a claim under this policy must have Your permission and observe the terms under this policy.
  • Third Party Rights
    Unless expressly stated in this insurance, nothing in this insurance will create any rights in favour of any person pursuant to the Contracts (Right of Third Parties) Act 1999.
  • Waiver
    If We or any You fail to exercise or enforce any rights conferred on them by this insurance, the failure to do so will not be deemed to be a waiver, nor will it bar the exercise or enforcement of, such rights at any subsequent time.
  • Recoveries
    We reserve the right, at Our own expense, to take over proceedings in the name of the You to recover any payment made under this policy. If You recover costs and expenses previously paid under this policy, such costs and expenses must be immediately repaid to Us.

5. Governing Law

This policy is subject to the law applicable to Your place of residence in the United Kingdom.

6. Assignment

This insurance is between and binding upon Us and You and their respective successors in title, but this insurance may not otherwise be assigned by You without Our prior written consent.

CANCELLATION

Your Cancellation Rights

Cooling Off Period

You may cancel this policy up to 14 days after You receive this policy document to receive a full refund. You can exercise this right by contacting the Administrator on …….. or email admin@warrantysolutions.co.uk.

After the 14-day “cooling off period” has expired, You may cancel the policy by giving the Administrator fourteen (14) day’s notice in writing. The Administrator will calculate, and advise You of, the amount of any premium refund due under this Insurance calculated as follows:-

  1. from the premium (including Insurance Premium Tax) You paid for this Insurance, We will deduct a cancellation fee of £15 to cover the administrative costs of cancelling this Insurance and dealing with refunds of premium, commission, and Insurance Premium Tax, and
  2. any actual cost We have incurred in respect of any claims You have made under this Insurance.
  3. From the result, We will calculate a proportionate refund of premium based on the number of complete months that Your Insurance has left to run at the date You request cancellation.

Your policy will end automatically if We have provided You with a replacement appliance or monetary settlement. No policy refunds will be due.

Our Cancellation Rights

We may cancel this policy at any time provided that We give You 7 days notice of cancellation and there is a valid reason for doing so. Valid reasons for cancellation include, but are not limited to fraud, dishonesty and any outstanding amount due from You in relation to any other claim under the policy.

Where We cancel this policy no refund of premium will be available. If We cancel the policy We will write to You at Your address shown in Our records.

HOW TO MAKE A COMPLAINT

It is the intention to give You the best possible service but if You do have any questions or concerns about this insurance or the handling of a claim You should contact the Manager of the Administrator. The contact details are:

Please ensure Your policy number is quoted in all correspondence to assist a quick and efficient response.

We will contact You within five days of receiving Your complaint to inform You of what action We are taking. We will try to resolve the problem and give You an answer within four weeks. If it will take Us longer than four weeks We will tell You when You can expect an answer.

Alternatively, at any stage, You may have the right to contact the Financial Ombudsman Service who can review complaints from ‘eligible complaints’ which includes private individuals and sole traders and small partnerships with a yearly turnover of less than £1 million.
